Judge In Supreme's Trial Say "Death Penalty Is Unlikely"

NEW YORK: A judge at the federal murder conspiracy trial of a crack kingpin with ties to the rap music industry warned prosecutors that pursuing a death sentence would be a waste of time and money.

"There's no chance in the world there would be a death penalty verdict in this case," U.S. District Judge Frederic Block said.

"If I'm wrong, I will have egg on my face," the Brooklyn judge said Wednesday while jurors were on a break amid closing arguments in the guilt phase at the trial of Kenneth "Supreme" McGriff. "But I will not be incorrect."

Block advised prosecutors to contact their superiors in Washington and ask them to reconsider their decision to seek a death sentence. Even if McGriff is convicted in a contract killing conspiracy, going forward with a penalty phase would be pointless, he said.

"There's just no chance that 12 jurors will vote for the death penalty in this case, and I think it is good for us to save money, if we can do that, and judicial resources," he said.


A spokesman for the U.S. attorney's office declined to comment.

The jury deliberated briefly Thursday afternoon without reaching a verdict. It was to resume Friday morning.

In the 1980s, McGriff founded the Supreme Team, a profitable and ruthless drug crew that became legend on the same Queens streets that later produced rap stars such as Ja Rule and 50 Cent. Authorities allege that after serving time for a drug conviction, McGriff resumed his drug dealing operations and paid $50,000 (€38,526) to have two rivals killed.

His lawyer said that McGriff sought to turn his life around by producing music and movies with the help of Irv "Gotti" Lorenzo, a neighborhood friend who headed the successful Murder Inc. record label. At a trial last year, prosecutors had alleged Lorenzo laundered more than $1 million (€770,000) in McGriff's drug proceeds through the label; Lorenzo was acquitted.

McGriff produced a straight-to-video film, "Crime Partners 2000" that featured Ja Rule, Snoop Dogg and Ice-T. The movie, about two hit men, was released in 2001.

LT Hutton produced this track it is Ashanti's second time to work with LT as they worked together on "Pac's Life" so expect to hear from the duo on her album if these two tracks are to go by. Defense Says Preme's Legit, As Prosecution Provides Murderous Evidence

As the double-murder trial for druglord Kenneth "Supreme" McGriff continued yesterday (January 23), the defense attempted to portray Preme as a legitimate businessman and potentially damaging evidence was introduced in the case.

In an effort to describe the legitimacy of McGriff's business dealings and discredit money laundering claims, the defense called on Ray "Uncle Ray" Copeland, DMX's former manager, Supreme's sister Barbara, who worked for his company Picture Perfect, and the owner of Club Amazura in Jamaica, Queens.

They also called upon Bentley Maurice, publisher for Holloway House. Maurice, who owns the rights to 16 of author Donald Goines' novels, testified that McGriff bought the rights to Goines' Crime Partners for $135,000. Supreme turned the novel into a film in 2001, starring Ice-T and Snoop Dogg and reportedly purchased the rights to Goines' Black Gangster in an effort to bring it to the screen as well. The movie never materialized.

The defense successfully pointed out that funding for the Crime Partners' soundtrack came from Def Jam and the money for the film came from various sources, yet only McGriff is facing criminal charges.

While McGriff looked to have many hip-hop heavyweights testify including Jay-Z, the Gotti brothers and 50 Cent, many declined. McGriff, who had business dealings with Jay-Z and Irv and Chris "Gotti" Lorenzo, had an interesting relationship with 50 Cent which is explored in the book Queen Reigns Supreme.

Despite the potential progress for the defense, key pieces of evidence were also introduced by the prosecution. Two camcorders found in an apparent Maryland stash house with a tape of Eric "E Money Bags" Smith's shooting, were introduced. Four guns, allegedly used in the murder of Smith and two more guns, allegedly used in the murder of Troy Singleton, were also put into evidence, as well as a print out of two-way pager messages dating back from July of 2001 to December 2002.

It is believed that the defense could rest their case today (January 24), leaving McGriff's fate in the hands of the racially diverse jurors by as early as tomorrow. While McGriff faces the death penalty if convicted, he displayed a calm demeanor throughout yesterday's proceedings and can be seen daily smiling, winking and waving at his supporters in the courtroom.
